Driller to NY: Stop the local bans or we'll sue

Yahoo Finance -- Gas driller threatens to sue NY if state agency doesn't act to stop local bans and moratoriumsALBANY,

N.Y. (AP) -- A natural gas drilling company is taking a new tack in the industry's fight against local drilling bans: It's threatening to sue if New York regulators don't step in and extinguish the prohibitions.

John Holko, president of Lenape Resources, sent a letter Thursday to state Department of Environmental Conservation Commissioner Joe Martens saying a moratorium prohibiting natural gas development in the Livingston County town of Avon forced his company to shut down its wells there.

this is funny..but i'm afraid the worst is yet to come..

most cities do have a one mile extra-territorial jurisdiction though, and some towns, like the one i live in, has a two mile jurisdiction..

You cannot have one set of rules in one town and 25 feet away, another set. That makes no sense at all and NY knows it.

In general, property use decisions should be made at the lowest level of government that has jurisdiction - property owners and municipalities can overrule state regulations. But since activity must obey rules at all levels of government, it works out that the most restrictive regulations take precedence. Gas companies will have to go outside the city limits to do their drilling. Cities have no authority to control activity beyond their borders.

Don't banning fracking. Just require the companies to post insurance bonds. I can't drive without insurance because I might cause an accident. Although the chance of me causing an accident is higher than the 1% chance of a fracking accident the potential damage is less. So, require the drillers to post a bond wherein they have to buy the properties, at full market value, plus interest and legal fees if they delay settling, if they contaminate the water.

Pass a law requiring all trucks to disclose what chemicals they are carrying within your municipality. Have a $10,000 fine for anyone who doesn't comply. Seize the truck.
